These Terms of Use govern your access to and use of Kargen.ai. By using Kargen.ai, you agree to these Terms.

If you are using Kargen.ai on behalf of a company, you confirm that you have authority to bind that company to these Terms.

2. Description of Service

Kargen.ai is a freight operations automation platform that helps freight brokers process RFQs, carrier quotes, negotiation emails, load-related communication, and operational workflows.

The platform may connect to Gmail or Google Workspace accounts with user authorization.

3. User Responsibilities

You are responsible for:

• Ensuring you have authority to connect any mailbox or business account to Kargen.ai.

• Reviewing important outputs, extracted data, replies, quotes, and automation actions before relying on them.

• Ensuring your use of Kargen.ai complies with applicable laws, contracts, customer requirements, carrier agreements, and internal company policies.

• Keeping your login credentials secure.

4. Google Account Access

Kargen.ai may request access to your Gmail or Google Workspace account to provide freight workflow automation.

You authorize Kargen.ai to access and use your Google user data only for the purposes described in our Privacy Policy and within the permissions you grant through Google OAuth.

You may revoke Google access at any time through your Google Account permissions or Kargen.ai account settings, where available.

5. No Guarantee of Accuracy

Kargen.ai may use automation, rules, AI models, and third-party services to process emails and freight data.

While we aim to provide accurate results, we do not guarantee that extracted shipment details, classifications, suggested replies, pricing guidance, or workflow actions will always be complete, accurate, or error-free.

Users are responsible for reviewing and approving business-critical actions.

6. Prohibited Use

You may not use Kargen.ai to:

• Violate applicable laws or regulations.

• Send spam, deceptive, unlawful, or unauthorized communications.

• Access mailboxes or data without proper authorization.

• Interfere with the security or operation of the service.

• Reverse engineer, copy, resell, or misuse the platform except as allowed by a written agreement.

7. Customer Data

You retain ownership of your business data. By using Kargen.ai, you grant us the limited right to process your data only as needed to provide, secure, maintain, and improve the service.

8. Third-Party Services

Kargen.ai may integrate with third-party services such as Google, email providers, cloud infrastructure, load boards, TMS platforms, compliance providers, and analytics tools.

Your use of third-party services may be subject to their separate terms and policies.

9. Confidentiality

We will use reasonable efforts to protect confidential business information processed through Kargen.ai.

You agree not to disclose non-public product, pricing, technical, or business information about Kargen.ai without written permission.

10. Suspension or Termination

We may suspend or terminate access if we believe there is misuse, security risk, non-payment, legal risk, or violation of these Terms.

You may stop using Kargen.ai at any time.

11. Limitation of Liability

To the maximum extent permitted by law, Kargen.ai and Nearing Labs Pvt. Ltd. will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunities.

12. Disclaimer

Kargen.ai is provided on an "as is" and "as available" basis. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by law.

13. Changes to Terms

We may update these Terms from time to time. Continued use of Kargen.ai after updates means you accept the revised Terms.

14. Governing Law

These Terms are governed by the laws of India, unless a separate written agreement states otherwise.
